NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.
Eligibility. Contest is open only to females who are legal residents of the 50 United States or the District of Columbia, and who are 21 years of age or older at the time of entry. Not open to employees, or members of the immediate family or household of employees, of Touch, LLC (“Sponsor”), General Media Communications, Inc. (“GMCI”), or any of their respective parents, subsidiaries, or affiliates, or any advertising or promotion agencies involved in the production or promotion of this Contest (collectively, the “Released Parties”).
No Purchase Necessary. To enter, come to the Pure Nightclub at Caesars Palace, 3570 Las Vegas Blvd South, Las Vegas, Nevada, on either November 7 or December 5, 2009, for a Preliminary Competition to be held on each of those nights, starting at approximately 11:30 p.m. Registration for each Preliminary Competition will be available from approximately 6:00 p.m. through 11:00 p.m. on the date of the Preliminary Competition. Be sure to arrive early to get in line, but please do not arrive before 6:00 p.m. No loitering or camping out will be allowed.
A maximum of twenty (20) contestants will be able to participate in each Preliminary Competition. If more than twenty (20) contestants sign up on either evening, each contestant may be required to pose briefly for one or more judges in a pre-screening round to select the twenty (20) contestants for that evening's Preliminary Competition. Any such pre-screening round will be conducted at our around 9:00 p.m. on the date of the Preliminary Competition. Failure to be present when called for any pre-screening round may result in disqualification. Any pre-screening will be based on the same judging criteria as outlined below for the Preliminary Competitions (except audience appeal).
As a condition of and prior to entry, each contestant will be required to sign a release agreeing to abide by these Official Rules and granting Sponsor all rights to contestant's performance and any audio and/or visual recordings or photographs thereof. Failure to do so upon request will result in disqualification.
Preliminary Competition Judging. Contestants in each Preliminary Competition will be given the opportunity to make an on-stage appearance before a panel of judges and a live audience. The appearance will last no more than approximately 15 minutes. Contestants may dress in attire of their choice; however nudity and exposing of genital areas or areola are strictly prohibited. Contestants may pose, walk, sing or dance or otherwise perform as they wish; however, any conduct, language or attire by any contestant that is deemed offensive, threatening, insulting or otherwise inappropriate for any reason by the judges or the Sponsor may result in immediate disqualification and removal from the Contest. Contestants will be judged by a panel of judges on the following four (4) criteria, giving equal weight to each: looks, presentation, energy/excitement, and audience appeal. The decisions of the judges are final and binding in all respects. By entering this Contest you agree to abide and be bound by the decisions of the judges.
The top five (5) contestants (assuming there are at least five eligible contestants) selected by the judges in each Preliminary Competition will be given the opportunity to compete as Finalists in the Final Competition at the Pure Nightclub, scheduled for January 8, 2010, as described below. Any contestant not selected as a Finalist at the November 7 Preliminary Competition is eligible to enter again for the December 5 Preliminary Competition.
Final Competition. Each Finalist will be provided with round-trip transportation to and from Las Vegas for the Final Competition for herself and one guest. Transportation may be via air or ground, in Sponsor's discretion, depending on distance of Finalist's home in the United States from Las Vegas, Nevada. Any air transportation will be coach class via Southwest Airlines from the gateway airport which is serviced by Southwest Airlines that is nearest to the Finalist's residence, not to exceed $500 per person and ground transportation to and from the airport in Las Vegas. Each Finalist will also be offered a hotel room at the Luxor Hotel in Las Vegas for the night of January 8, 2010, as well as dinner that night at Company Kitchen and Pub House. Transportation, hotel, and dinner are non-transferable and may not be substituted or redeemed for cash. Failure to be available for the Final Competition on January 8, 2010, may result in disqualification and selection of an alternate Finalist. Approximate retail value of Finalist package is $10,000 actual value may vary depending on departure city.
Each Finalist and guest must travel on the same itinerary on days designated by Sponsor to coincide with the Final Competition, scheduled for January 8, 2010. Finalist and guest must each have appropriate travel documentation. Dates and locations for all events are subject to change. In the event the date of the Final Competition must be changed for any reason, Finalists must be available for the new date. Failure to be available may result in disqualification and selection of an alternate Finalist. Each Finalist is responsible for all taxes on her Finalist trip package, and prize that she may ultimately win, and for all costs not specifically listed in these Official Rules, including any meals, gratuities, etc. Major credit card may be required at hotel check-in to cover any incidental expenses. Travel guest must be at least 21 years of age and sign a liability release prior to travel. Failure to sign and return these forms when requested may result in forfeiture of prize and selection of an alternate Finalist.
The Final Competition will be conducted in the same manner as the Preliminary Competitions, with the same judging criteria and process, to select one (1) overall winner from among all the Finalists. A maximum of ten (10) Finalists will be allowed to compete.
Prize. The winner will receive the opportunity to pose for a photography shoot and a possibility that the photography could be published in Penthouse Magazine. A photography shoot does not guarantee the pictures will be published in Penthouse Magazine. The winner will be required to execute GMCI's standard model release and agreement. The photography shoot will take place at a location selected by GMCI in its sole discretion. If the location is no more than 100 miles away from the winner's residence, the winner will be responsible for her own transportation and other expenses to attend the shoot. If GMCI elects to move the shoot to a more distant location, GMCI will provide appropriate round-trip coach-class transportation and reasonable and necessary meals (maximum $40 per day) to attend the shoot. The photography session will require full frontal and genital nudity. If the photographs are published, the winner will be paid the standard rates in effect at the time of publication for new models appearing for the first time in the magazine of publication. If the winner is published in a full photographic spread in Penthouse she may be eligible to be selected as Penthouse Pet of the Month and if so she will be eligible to compete for the title of Penthouse Pet of the Year. Prize package has no retail value other than value of any transportation, accommodations and meals furnished in the event the shoot is more than 100 miles from the winner's home in the United States, which is estimated to be between $500 and $1,000, but the actual value may vary depending on departure city. The date of the shoot is in GMCI's sole discretion. Winner must be available on the date(s) specified by GMCI; failure to attend the shoot on designated date(s) or to execute GMCI's model release and agreement or other required documents may result in forfeit of the opportunity to be photographed and the selection of another prize winner.
Conditions. Participation in the Contest and any related activities constitutes your consent for the use of your image, likeness, voice, name and other personal characteristics that may be captured in audio, visual, photographic, or any other recording or memorializing of the Contest or related activities (“Recordings”). Any Recordings may be reproduced, transmitted, broadcast, published, altered and sold by GMCI and its designees without limitation, in perpetuity, in any and all media now known or hereafter devised. By participating in the Contest, you further agree to release and hold Sponsor and its directors, officers, employees and agents, and all prize suppliers and other Released Parties harmless from any and all losses, damages, rights, claims, and actions of any kind or resulting from participation in the Contest or any related activities, as well as the acceptance, possession, use or misuse of any prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, whether suffered by you or a third party.
Additional Terms. Sponsor reserves the right, in its sole discretion, (a) to modify, terminate, or suspend this Contest should unauthorized intervention or other causes beyond Sponsor's control corrupt or impair the administration, security, fairness or proper operation of the Contest, and (b) to disqualify any individual found to be tampering with the entry process or the operation of the contest; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Without limiting any other provision of these Official Rules, the following instructions and conditions apply to participation in the Contest:
What to Bring: You must bring identification that shows your proof of your age.
What to Wear: Please do not wear any clothing items that have designer names, sports teams, or any other logos or brand names, or bearing the name or likeness of a celebrity, living or dead. If you do wear such clothing, you may be required to remove it or turn it inside out or put on additional clothing to cover it. Nudity or exposure of genital areas or areola during the Contest are strictly prohibited.
Rules in Line: Please be courteous to other people in line. Do not cut in line. If Sponsor discovers that you have cut in front of another person in line, you will be disqualified from the Contest. Also, you may not hold a place in line for another person for an extended period of time. Sponsor reserves the right to audition people out of order of their place in line.
NO WEAPONS, ALCOHOL, OR NON-PRESCRIPTION CONTROLLED SUBSTANCES WILL BE PERMITTED AT ANY AUDITION OR DURING THE CONTEST.
By participating, you agree to be bound by these Rules and all decisions of the judges, which are final and binding. Your presence at the Contest, and the presence of your friends, family members, and anyone accompanying you, constitutes your and their consent and agreement to the recording and use of your and their performance, appearance, name, voice, singing voice, likeness for all purposes (including but not limited to publishing, entertainment, advertising, marketing, promotion, merchandising and the exploitation of any and all ancillary and subsidiary rights), as the same may be edited, in all media now known or hereafter created, throughout the universe, in perpetuity for no compensation, unless otherwise required by law or otherwise expressly specified in these Official Rules. Each contestant and guest may be required to sign and return a document confirming the foregoing, prior to or after participating in the Contest. If you and/or your friends, family, or anyone else accompanying you to the Contest, do not wish to be photographed, or do not agree with these terms, please do not attend the Contest. Your and/or their attendance at the Contest will be conclusively deemed to be a waiver of any and all claims for invasion of privacy, defamation, etc. All federal, state and local laws apply. Contestants and guests agree (for themselves and their heirs) that Released Parties are not responsible for, will have no liability for, and will be held harmless for: i) any failure of transportation, bad directions, or the inability, for any reason, of any person to appear at the Contest venue or appear before the judges; ii) any injuries, losses or damages of any kind caused by traveling to or from the Contest venue, being present at the Contest venue, participating in the Contest, or by reason of the acceptance, possession, use or misuse of any prize; or iii) any printing, typographical or technological errors in any materials associated with the Contest, even if caused or contributed to by the negligence of Released Parties.
Validations. Sponsor and GMCI reserve the right to confirm the accuracy of all information furnished by any contestant, to perform background checks, and, in their discretion, to disqualify anyone who has engaged in any activity at any time that is inappropriate to the image of Sponsor, GMCI, or the Contest.
